Killer whale attack at Sea World

Could Ken Peters, employee and killer whale trainer at Sea World, potentially sue Sea World under the wild animals category of strict liability?

  1. Take a look at this story from 1988:

Former Sea World Trainer Sues Over Injuries Caused by Whale
    (notice: two pages long)

    In my opinion....

In this case, the plaintiff says the defendant neglected to tell her about the dangerous behavior of the killer whales. I find it hard to believe SeaWorld would be so foolish to not discuss the potential dangers with training such large, dangerous animals when the the trainer was hired. If her claim is true, SeaWorld had it coming to them.

Following the plaintiff's incident, SeaWorld staff should have definitely acted differently. Either certain protocol was ignored or no protocol existed for these situations - in either case, her injuries were most likely exacerbated by the staff and should be liable.
