    shouldn't judges be judicial activists so that when technological and social changes occur the judges can make laws that the founding fathers couldn't have foreseen. There will always be gray area in certain situations and it is up to the judges to make the right decision.

    Ok, but why are judges in the best position to make these decisions? Isn't the legislative branch capable of this?
