8. Yes, the court should enforce a second contract because the seller followed Nevada law. Upon the second offer, the buyer was not forced to accept. Therefore, the second contract is a legitimate one.

12. The court should enforce the oral contract made seeing that Arnoe held up his side of the deal, regardless if the bank was forced to forgo the account. An oral contract is as valid as a written one.
